Welcome to FocusArt Kids. These Terms of Use (“Terms”) govern your use of FocusArtKids.com and any lessons, memberships, videos, materials, or other services provided by FocusArt Kids LLC (“FocusArt Kids,” “we,” “us,” or “our”).

By accessing our website, creating an account, purchasing a membership, or using FocusArt Kids, you agree to these Terms.

1. Parent or Guardian Account

FocusArt Kids provides educational drawing content for children, but accounts, purchases, subscriptions, and communications with FocusArt Kids are intended to be managed by a parent, legal guardian, or other responsible adult.

If you allow a child to use FocusArt Kids, you are responsible for supervising their use of the program and determining whether the lessons are appropriate for them.

Children should not independently submit personal information, make purchases, or create accounts.

2. FocusArt Kids Program

FocusArt Kids is an online guided drawing program that may include:

  • Recorded drawing lessons

  • A progressive drawing curriculum

  • Educational materials and guides

  • Access to previously released lessons

  • Customer support

  • Other related resources

Program content, lesson length, release schedules, instructors, features, and materials may change over time as we improve the program.

3. Educational Purposes Only

FocusArt Kids is an educational art program.

It is not medical care, therapy, occupational therapy, behavioral therapy, psychological treatment, or a substitute for professional healthcare or educational services.

References to focus, confidence, independence, fine motor skills, creativity, or other potential benefits describe skills the program is designed to support. Individual experiences and results will vary.

We do not guarantee any particular developmental, behavioral, educational, artistic, or therapeutic outcome.

4. Membership and Billing

Unless otherwise stated at checkout, FocusArt Kids membership is billed monthly at the price displayed when you enroll.

By purchasing a subscription, you authorize us or our payment processor to automatically charge your selected payment method each billing period until you cancel.

Your subscription automatically renews each month unless canceled.

5. Promotional Offers

From time to time, FocusArt Kids may offer free lessons, trials, introductory pricing, discounts, or other promotions.

Promotional terms may vary and will be disclosed with the applicable offer.

Unless otherwise stated, introductory discounts apply only for the stated promotional period, after which the membership renews at the regular price shown when you enrolled.

Promotional offers may not be combined and may be modified or discontinued at any time.

6. Cancellation

You may cancel your FocusArt Kids membership at any time.

Unless otherwise stated, cancellation stops future recurring charges. You will generally retain access through the end of the billing period you have already paid for.

Fees already charged are generally non-refundable except where required by law or expressly stated otherwise.

7. Membership Pauses

Where available, members may request to pause their membership.

Pause availability, duration limits, and any conditions are determined by the policy in effect at the time of the request and will be disclosed on our website, during checkout, or by customer support.

We may modify or discontinue the pause option at any time.

8. Lesson Access

Access to lessons and program materials is provided while your membership remains active, unless otherwise stated.

We may add, remove, replace, update, reorganize, or modify lessons and materials over time.

We do not guarantee permanent access to any particular lesson, video, instructor, feature, or piece of content.

9. Appropriate Participation

Parents and guardians are responsible for determining whether a particular activity is appropriate for their child.

Drawing activities should be completed in a safe environment using age-appropriate materials and appropriate adult supervision when necessary.

If your child becomes uncomfortable, frustrated, distressed, or unable to participate safely, stop the activity and use your own judgment about whether and when to continue.

10. Intellectual Property

All FocusArt Kids videos, lessons, curriculum, graphics, text, worksheets, teaching methods, branding, website content, and related materials are owned by or licensed to FocusArt Kids and are protected by intellectual property laws.

Your membership gives you a limited, personal, non-exclusive, non-transferable right to use FocusArt Kids materials for your household’s personal educational use.

You may not:

  • Copy, reproduce, distribute, sell, or commercially exploit our materials

  • Upload or share lesson videos publicly

  • Share your login with unrelated households

  • Record or redistribute paid lessons

  • Create competing materials substantially derived from FocusArt Kids content

  • Remove copyright, trademark, or other ownership notices

11. Artwork and Content You Share With Us

If you voluntarily send us artwork, photographs, testimonials, comments, or other materials, you retain ownership of your original content.

We will not publicly use a child's photograph, name, likeness, or personally identifying information for marketing merely because it was submitted to us.

If we would like to feature identifiable child-related content publicly, we may request separate permission from the parent or guardian.

12. Website and Account Security

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

Please contact us promptly if you believe your account has been accessed without authorization.

You may not attempt to interfere with, damage, reverse engineer, disrupt, or gain unauthorized access to our website, systems, or services.

13. Third-Party Services

FocusArt Kids may use third-party providers for services such as payment processing, website hosting, email communications, analytics, or video delivery.

Your use of certain third-party services may also be subject to their terms and privacy policies.

We are not responsible for third-party websites or services that we do not control.

14. Availability of the Service

We aim to keep FocusArt Kids available and operating reliably, but we cannot guarantee uninterrupted or error-free access.

Temporary outages, maintenance, technical problems, or circumstances outside our control may occasionally affect availability.

15. Disclaimer of Warranties

To the fullest extent permitted by law, FocusArt Kids and its content are provided on an “as is” and “as available” basis.

We make no warranty that the program will produce any particular result or that every child will enjoy, complete, engage with, or benefit from every lesson.

Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by law, FocusArt Kids LLC and its owners, employees, instructors, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the program.

To the fullest extent permitted by law, our aggregate liability arising from FocusArt Kids will not exceed the amount you paid to FocusArt Kids during the six months immediately preceding the event giving rise to the claim.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

17. Termination

We may suspend or terminate access to FocusArt Kids if we reasonably believe an account is being used fraudulently, unlawfully, abusively, or in violation of these Terms.

If we terminate a paid membership without cause, we may provide an appropriate prorated refund where applicable.

18. Privacy

Your use of FocusArt Kids is also subject to our Privacy Policy.

Parents and guardians should review our Privacy Policy before allowing a child to participate in FocusArt Kids.

FocusArt Kids does not knowingly collect personal information from children under 13 without verifiable parental consent. Our practices regarding children’s information are described in our Privacy Policy, which parents and guardians should review before allowing a child to participate.

19. Changes to These Terms

We may update these Terms periodically.

If we make material changes, we may provide notice through our website, account, or email.

The updated Terms will become effective on the date stated at the top of the document.

20. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, except where applicable consumer-protection law requires otherwise. Any legal action arising out of or relating to these Terms or FocusArt Kids shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
